1. Acceptance of Terms
By creating an account or using Queudio ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years of age to use Queudio. By using the Service, you represent that you meet this requirement. If you are between 13 and 18, you represent that a parent or guardian has reviewed and consented to these Terms.
3. Description of Service
Queudio is a personal audio feed service that converts articles, web pages, and PDF documents into audio files for personal listening. The Service uses third-party AI and text-to-speech technologies to process submitted content.
4. User Accounts
You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to provide accurate information when creating your account and to notify us promptly of any unauthorized access.
5. Content You Submit
Your ownership: You retain all ownership rights to content you submit to Queudio, including articles and PDF documents.
License to Queudio: By submitting content, you grant Queudio a limited, non-exclusive license to process, store, and convert that content solely for the purpose of providing the Service to you. This license ends when you delete the content or close your account.
Your responsibility: You are solely responsible for ensuring you have the legal right to submit and convert any content you provide. Queudio is a personal productivity tool intended for content you have legitimately accessed. Queudio does not monitor submitted content and is not responsible for copyright infringement by users.
6. Prohibited Uses
You agree not to use the Service to:
- Submit content you do not have the right to access or convert
- Circumvent paywalls or access controls you have not legitimately paid for
- Upload malicious files or content designed to interfere with the Service
- Resell, redistribute, or commercialize audio generated by the Service
- Violate any applicable law or regulation
7. DMCA and Copyright
Queudio respects intellectual property rights. If you believe content on the Service infringes your copyright, please send a takedown request to support@queudio.com. We will review and act on valid DMCA requests promptly. Repeat infringers will have their accounts terminated. See our full DMCA policy.
8. Subscriptions and Billing
Queudio offers free and paid subscription plans. Paid plans are billed on a recurring basis through our payment processor.
Refunds: Refund requests are handled at Queudio's sole discretion. To request a refund, contact us at support@queudio.com. We will review each request individually.
Plan changes: You may upgrade or downgrade your plan at any time. Changes take effect at the next billing cycle unless otherwise stated.
9. Termination
Queudio reserves the right to suspend or terminate your account immediately and without notice if you violate these Terms or engage in conduct we determine to be harmful to the Service or other users. Upon termination, your access to the Service and any stored audio files will cease. You may also delete your account at any time from your account settings.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Queudio does not warrant that the Service will be uninterrupted, error-free, or that audio output will be accurate or complete. We do not guarantee the availability or preservation of any audio files or account data.
11. Limitation of Liability
To the fullest extent permitted by law, Queudio and its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of audio files, or loss of access to the Service, regardless of the cause. Our total liability to you for any claim arising from the Service shall not exceed the amount you paid to Queudio in the three months preceding the claim.
12. Privacy and Data
What we collect: Your email address, usage data, submitted content (articles and PDFs), and generated audio files.
How we use it: To provide and improve the Service, send transactional emails (sign-in codes, digest emails, expiry notices), and process your content into audio.
Audio files: Generated audio is stored on Queudio's infrastructure. PDF-derived audio files are automatically deleted after 90 days of inactivity, with a warning email sent 7 days before deletion.
We do not: Sell your data to third parties, use your content to train AI models, or share your submitted content with other users.
Third-party services: Queudio uses third-party providers including Supabase (database), OpenAI (AI processing and text-to-speech), Cloudflare (audio storage), and Stripe (payments). Each provider's own privacy policy governs their handling of data.
13. Changes to These Terms
Queudio may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Ohio, and you consent to personal jurisdiction in those courts.
